Is In The Air and So Is Another Round of OFCCP Audit Activity
Another
round of Corporate Scheduling Announcement Letters (CSALs) has been sent by
the OFCCP for Fiscal Year 2010. As with previous CSALs, the “Spring
2010” letters are mailed to contractors with more than one establishment
listed on the OFCCP’s FY2010 audit schedule. The CSALs alert
contractors as to which of their establishments are likely to be scheduled
for an audit during the remainder of FY2010.
The
OFCCP has now eliminated its 25-facility limit on the number of new
compliance evaluations the Agency can conduct on a contractor’s facilities
during a single fiscal year. All facilities identified in a CSAL may
not actually be scheduled for an audit. This is merely a “heads-up”
warning. Furthermore, in some cases an unscheduled audit could
still occur. Contract award notices, individual complaints,
subsequent scheduling releases, and conciliation agreement monitoring are
reasons the OFCCP has given for scheduling audits at facilities not
appearing on a CSAL.
In
most cases, the CSALs are addressed generically to the Company President or
Chief Executive Officer so the HR department should advise the offices of
those executives to be on the look-out for any letters from the OFCCP or
U.S. Department of Labor.
