Mandatory Job Listing Requirement Update
and EEOC Public Hearing Remarks

Contractors may continue to use the America's Job Bank (AJB) after December 1, 2003 to fulfill the mandatory job listing requirement for covered veterans (41 CFR 60-250.5). As of December 1, contractors will have the following three options for meeting the listing requirement:

1) America's Job Bank (www.ajb.org)
2) Local Employment Service Delivery System
3) Veterans' Job Clearinghouse (www.jobsforveterans.org)

However, required changes to the regulations for covered veterans in 2004 may limit these options. Information regarding the current status of listing requirements can be found on the Veterans' Job Clearinghouse website (www.jobsforveterans.org). Additionally, some Federal contractors received an email from the AJB that provided information concerning the listing requirement. Those of you who did not receive this email may view a copy on our website at www.malyconsulting.com/notice.html.

Equal Employment Opportunity Commission (EEOC) Public Hearing Remarks
Remarks from the EEOC's October 29, 2003 public hearing regarding proposed changes to the EEO-1 Report (Standard Form 100) can be found on the EEOC website at www.eeoc.gov/meetings/10-29-03. It appears unlikely that any changes will be made to the EEO-1 Report until at least 2005.

If you have any questions about information presented here or would like further information about the mandatory listing requirement, please give us a call. We are happy to discuss what these requirements mean for your organization.

The Compliance Alert is an almost monthly (that is, we don't publish if there is nothing of interest to report) email publication that addresses current compliance issues surrounding workplace affirmative action and the Labor Department's Office of Federal Contract Compliance Programs (OFCCP). This document is not legal advice and questions concerning specific legal issues should be addressed to legal counsel.

If you would prefer not to receive further issues of the Compliance Alert, simply respond to this email with the word "remove" in the subject line.
