2003 EO Surveys Issued top ^
The Office of Federal Contract Compliance Programs (OFCCP) began sending out 10,000 EO Surveys on December 30, 2003. The 2003 EO Survey has the same 12-page format as the 2002 and is due by March 26, 2004. Federal contractors are required to complete the EO Survey for only those establishments selected by the OFCCP. EO Surveys for multi-establishment federal contractors with selected establishments will be sent to the organization headquarters. More information regarding the EO Survey can be found on the OFCCP website (www.dol.gov/esa/ofccp).

Caution: As with the 2002 EO Survey, recipients of the 2003 EO Survey may be randomly targeted for OFCCP audits. It is important that forms be returned with accurate information that has been analyzed before submission. Do not simply file the forms. If one or more of your establishments receive an EO Survey and you would like our services to compile, audit, and submit the report on your behalf, please give us a call.

For existing Maly & Associates clients, we probably already have the necessary data to complete a thorough analysis and submit the forms for you.

OFCCP Posts Guidance on Release of Census 2000 Special EEO File top ^
The OFCCP clarified its position in a posted statement on when it will expect federal contractors to use the recently released 2000 Special EEO File in their affirmative action programs (AAPs). According to the OFCCP notice, the OFCCP will not expect the use of 2000 census data until 2005. The notice can be found on the OFCCP home page at www.dol.gov/esa/ofccp.

Construction Contractors Technical Assistance Guide Released top ^
Federal contractors with contracts for construction work have different affirmative action program requirements than contractors with supply and service contracts. The OFCCP has issued a new guide to assist construction contractors in fulfilling their affirmative action obligations under Title 41 of the Code of Federal Regulations (41 CFR 60-4). Again, the document can be downloaded from the OFCCP home page listed above.

The Compliance Alert is an almost monthly (that is, we don't publish if there is nothing of interest to report) email publication that addresses current compliance issues surrounding workplace affirmative action and the Labor Department's Office of Federal Contract Compliance Programs (OFCCP). This document is not legal advice and questions concerning specific legal issues should be addressed to legal counsel.

If you would prefer not to receive further issues of the Compliance Alert, simply respond to this email with the word "remove" in the subject line.
