New Employee
Rights Poster Requirement
The Department of Labor announced this week that Federal
contractors and subcontractors are required to inform employees of their rights
under the National Labor Relations Act (NLRA). The Final Rule
implementing Executive Order 13496 goes into effect on June 21, 2010.
Contractors must post the prescribed notice in all plants and offices in
plain sight with other required employee posters. A fact sheet and
printable copy of the notice are available from the DOL website at http://www.dol.gov/olms/regs/compliance/EO13496.htm.
This notice informs employees of their rights to organize and
bargain collectively with their employers and to engage in other protected
concerted activity. The notice also gives examples of illegal conduct
by employers and unions that interfere with an employee’s union rights, and
provides contact information to the National Labor Relations Board.
The Office of Federal Contract Compliance Programs (OFCCP) will be
responsible for checking that the notice is posted. All onsite audits
by the OFCCP will include an inspection of employee bulletin boards to see
if the notice is posted.
Executive Order 13496 also requires that contractors include
language referring to the posting requirement in all subcontracts entered
in connection to qualifying Government contracts.
